Welcome to Celasta. These Terms & Conditions ("Terms") govern your access to, browsing of, and purchases made through our website and platform. By accessing our platform, registering an account, or purchasing our embroidered garments, you agree to be bound by these Terms, along with our Shipping Policy, Refund Policy, Return & Exchange Policy, and Privacy Policy.

1. General Conditions & Account Eligibility

• Age Requirement: By using this platform, you represent that you are at least 18 years of age or accessing the site under the active supervision of a parent or legal guardian.
• Service Discretion: Celasta reserves the right to refuse service, terminate customer accounts, modify platform content, or cancel orders at its sole discretion without prior notice.
• Accuracy of Information: You agree to provide accurate, current, and complete account, shipping, and billing information for all purchases made on our store.

2. Intellectual Property Rights & Artwork Protection

• Ownership of Artwork & Designs: All content published on this website—including but not limited to custom embroidery patterns, motif concepts, artwork designs, garment cuts, photography, brand logos, graphics, text, and overall page layouts—is the exclusive intellectual property of Celasta and is protected under Indian Copyright, Trademark, and Intellectual Property laws.
• Strict Prohibition: You are strictly prohibited from copying, reproducing, replicating, altering, distributing, or creating derivative works from any of Celasta’s embroidery designs, photographs, or website content for commercial or personal exploitation without explicit prior written authorization from Celasta.

3. Product Representation, Artistry & Pricing

• Handcrafted Art Disclaimer: We make every effort to display product images, garment colors, and embroidery textures as accurately as possible. However, due to variations in digital screen displays and the handcrafted nature of embroidery, minor variations in thread color, placement, or stitch density may occur and are recognized as inherent characteristics of art-driven apparel.
• Pricing & Typographical Errors: In the event that a product is listed at an incorrect price or with incorrect information due to a typographical error, system bug, or administrative mistake, Celasta reserves the right to cancel or refuse any orders placed for that product. If your payment has already been processed, a 100% full refund will be credited back immediately.
• Product Availability: All orders are subject to stock availability. Celasta reserves the right to discontinue any embroidery design or limit order quantities without prior notice.

4. Order Acceptance, Payment & COD Terms

• Payment Processing: We accept prepaid payments via UPI, Credit/Debit Cards, and Net Banking through PCI-DSS compliant payment gateways (such as Razorpay or Paytm).
• Order Acceptance: Receiving an order confirmation email/SMS does not signify final acceptance of your order. An order is deemed accepted only after it is processed, packed, and dispatched by Celasta.
• Cash on Delivery (COD) Rules: If Cash on Delivery is enabled on our platform, Celasta reserves the right to verify COD orders via phone or WhatsApp prior to dispatch. Unjustified refusal or intentional non-acceptance of COD shipments at the doorstep may result in permanent suspension of COD privileges for your account.

5. Fabric Care & Post-Purchase Handling

• Washing & Maintenance: Due to the delicate nature of threadwork and embroidery, garments must be cared for strictly according to the care instructions provided (e.g., dry clean or gentle hand wash).
• Exclusion of Liability for Improper Care: Celasta shall not be held liable for damage, color bleeding, shrinkage, or thread unraveling caused by improper washing, ironing directly over embroidery, aggressive detergent usage, or normal wear and tear after delivery.

6. Limitation of Liability

• To the fullest extent permitted under applicable Indian laws, Celasta, its directors, owners, and employees shall not be liable for any indirect, incidental, punitive, special, or consequential damages resulting from your use of the website or purchased products.
• In any circumstance, Celasta's total cumulative financial liability to you for any claim, loss, or legal dispute arising out of an order shall strictly not exceed the total purchase price actually paid by you for that specific item.

7. Force Majeure

Celasta shall not be held liable or responsible for any delay, failure in delivery, or non-performance resulting directly or indirectly from causes beyond our reasonable control, including but not limited to acts of God, extreme weather events, natural disasters, courier/logistics network strikes, supply chain disruptions, regional lockdowns, or government-imposed curfews.

8. Dispute Resolution, Governing Law & Jurisdiction

• Governing Law: These Terms, along with all store policies, shall be governed by, interpreted, and construed in accordance with the laws of India.
• Exclusive Jurisdiction: Any dispute, controversy, claim, or legal proceedings arising out of or relating to your interaction with Celasta shall be subject to the exclusive jurisdiction of the competent courts located in Karnataka, India.

9. Modifications to Terms

Celasta reserves the right to update, modify, or replace any part of these Terms & Conditions at its sole discretion. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any updates constitutes acceptance of those changes.
